AT&T is locked in a fierce legal and regulatory battle with California, accusing the state of stubbornly clinging to an outdated copper wire network while simultaneously claiming to support modernization. The dispute, escalating rapidly, centers on whether AT&T can retire its legacy infrastructure and transition to more modern technologies like fiber optics, a move that could impact nearly 200,000 customers.
The billion-dollar burden
For years, AT&T has been vocal about the financial strain of maintaining a network deemed obsolete by the company. California mandates that AT&T spend a staggering $1 billion annually to keep the copper lines operational, a cost the telecommunications giant argues is unsustainable and diverts resources from vital upgrades. This has led AT&T to file a lawsuit against the California Public Utilities Commission (CPUC) and the state attorney general, seeking permission to discontinue its wireline service.
Adding another layer to the complexity, AT&T has also petitioned the Federal Communications Commission (FCC), urging the agency to override California’s regulations and allow the company to phase out service for those 199,000 customers. As AT&T stated in its filing, the regulations have effectively “frozen in time” a network “aging, fragile, and expensive.”

Wireless replacement: a contentious point
California insists it’s allowing AT&T to replace copper wiring with fiber. However, AT&T maintains the state is demanding the continued use of the old copper infrastructure, forcing them to offer what they describe as 'Plain Old Telephone Service' (POTS). The crux of AT&T’s argument is that wireless service is a viable alternative, but California is unconvinced.
State regulators are now accusing AT&T of misleading the FCC in its pursuit of shedding the copper network. A recent filing alleges that AT&T has been perpetuating a false narrative for years, claiming California is preventing them from modernizing. The CPUC and state regulators assert that AT&T’s claims are “not and has never been true,” pointing to a 2008 decision where the CPUC specifically declined to implement rules that would hinder the replacement of copper with fiber, a decision aimed at fostering the buildout of fiber systems.

Coverage map confusion
AT&T initially attempted to demonstrate the adequacy of its wireless coverage using the FCC’s National Broadband Map. But California quickly countered, noting that the map displays broadband coverage, not voice coverage – a critical distinction for landline phone users. Next, AT&T turned to the FCC’s Mobile LTE Coverage Map, which does display voice coverage. However, a disclaimer explicitly states that the map reflects outdoor, stationary coverage, rendering it unsuitable for assessing indoor coverage, where most landline phones are used.
The carrier then presented its own coverage map, only to face another disclaimer revealing that it too only depicts approximate outdoor coverage. As California pointed out, “mobile service provider maps cannot reliably determine that a wireless service is an adequate replacement for a wireline service without further proof of indoor coverage.” The state highlights the simple reality: buildings and walls obstruct wireless signals.
Fcc’s shifting sands
While California solidifies its position, AT&T might have an advantage. Under FCC Chairman Brendan Carr, the agency recently issued an order streamlining the process for carriers to abandon copper networks. This could potentially preempt state laws that conflict with the FCC’s authorizations, setting the stage for a potential legal showdown between California and the federal regulator.
The outcome of this dispute will have significant implications for the future of telecommunications infrastructure in California and potentially across the nation, as other states grapple with similar decisions about legacy networks and the transition to modern technologies, with the question ultimately revolving around whether reliable indoor voice coverage can truly replace the dependable connection of a traditional landline.
